The Sala IV: Who Do They Think They Are?
Now here’s a government body with a God complex.
The Sala IV is the end all be all of Costa Rican law. The highest court in all the land. But who are these judges making these all powerful decisions? The reason I ask is because they seem to think their power is strong enough that they can even make decisions that have absolutely nothing to do with Costa Rica. Even go as far as over-ruling Supreme Courts of countries like Canada and the USA.
The Sala IV, which has the task of reviewing government acts or omissions in order to determine their compliance and compatibility with the nation’s constitution, has been sticking their noses in on issues as expansive as the environmental impact of the Crucitas open-pit gold mine in northern Costa Rica, the rights of homosexual couples, hindering police duties by making it unconstitutional to search a vehicle or make someone wear a seatbelt, the opening of the cellular phone market, the terrible state of Costa Rica’s pothole riddled roads and now…now they are even flexing their muscle in to cases not even relating to Costa Ricans let alone the constitution of the country.
Last week we saw the case of a Springfield…YES…Springfield USA in the state of Missouri, girl, born in the USA, whereas her mother Trina Atwell, kidnapped her from her father and fled to Costa Rica over two years ago now. Roy Koyama, the girl’s father, has been fighting in courts back home in Springfield and in Costa Rica, having won all of them…until the Sala IV chimed in.
Up until the Sala IV had the case, two courts ruled the child needed to be return back the US to her father and that the decisions in the US had to be honored here also.
Then when the all-mighty Sala IV got their hands on the case they made a disturbing decision that goes against any logic – the mother did nothing wrong and she is granted full custody and told that the daughter never has to return to the USA again.
Seriously though…is there a team of monkeys on that panel of judges?
A family of 100% US citizens – one kidnaps the child and runs to Costa Rica (a felony) and looses every legal fight (clearly not an issue for the CR courts) and then the highest court gives the big “finger” to the US courts and all the lower courts that ruled before them and says the unthinkable.
You might think of this as a bit of a rant of sorts but let me tell you something…I’ve experienced them myself.
Two Canadian tourists in Costa Rica. Not legally allowed to work. Not married in Costa Rica but rather back in Canada. An existing Supreme Court filing in Canada for divorce…Costa Rica’s lower family courts do the logical and decide that any assets here are divided equally however anything outside of that is for Canada to deal with (rightfully so). Then comes the Sala.
The Sala gets it and reverses everything and says that they don’t care what the Canadian Supreme Court says about the divorce and even go as far as to try and say that alimony could be claimed. WTF?
And don’t get me started on their math skills – granting 150% of all assets to the woman because…well she’s a woman. Furthermore, ignoring the 3000 page criminal case against her for 5 felony frauds.
Could you imagine a couple Costa Rican’s going to Canada on a vacation and suddenly getting in to a disagreement and one decides to file for divorce in Canada? What if Canada were to weigh in on alimony payments but based on Canadian salaries? And if alimony isn’t paid….jail time baby! That’s right…here in Costa Rica if you don’t pay “pension” you go straight to jail. Not likely…Canada would say…”go home and deal with your problems in your own country.”
I’m curious to know what gives the Sala any right whatsoever to make decisions on non-Costa Rican citizens or cases outside of their country?
Time to clip the Sala’s wings and bring them back to Earth with the rest of us logical thinkers. Minus the hypocrites who love it when it works in their favor but cry wolf when it doesn’t.

and strangely enough at the drop of a hat they will beg for money from those countries they disrespect. a good idea would be to stop interferring in places they have no biz being.
It is certainly interesting to read the steady flow of Sala IV experiences. Costa Rican have grown increasingly irritated by this body since their inception in 1989. Yes…they are relatively new to the country.

i think you are wrong the sala 4 is just reviewing that courts decisions of costa rica be according with law..and we dont need your permission to rule the decisions in Costa Rica, if you dont like you know where you have to go
greivin you are only half right. the sala 4 reviews but then often overrules many court decisions made by lower courts. many ticos are critical of them for this reason they never see eye to eye with other courts.
I agree. With both of you. They are suppose to review cases of lower courts HOWEVER…they do have an uncanny ability to completely see things in a different light (often without common sense) than the rest of the planet. I think it was only a few weeks back now when the Sala decided that some hardcore cop/criminals needed to be back on the street despite the clear and present danger of the informant who turned them in – also a police officer. What sense is there in that? Good thing the prosecutor put his job on the line by defying the judges decision and kept them in prison despite the ridiculous ruling.
I thank God for Sala 4. They have the courage to do what is right in spite of being pressured by countries that have a fear of offending minority groups.
It is ok to believe in protecting the innocent and those who cannot protect themselves. I am grateful that they could see and do the right thing to “Keep Emily Safe in Costa Rica” They took the time to investigate and read the court documments in Springfield, Mo showing that the father of Emily was abusive and that several reports of abuse had been made and sustained by a court order of restraint against him. Thank you Sala 4.
Interesting point of view however you’ve created more confusion by stating that Springfield courts ruled that the father was abusive against the child – if that were the case do you really think they would have ruled in favor of giving him full custody of Emily? Usually if something makes no sense…it isn’t true.
PS: for the record….the Sala IV has NEVER reviewed the court documents from Springfield USA so not sure where that came from.

The Presidential Police of the Arias-Chinchilla-U.S. Business Cartel spy on, violently attack Congressional representatives of Costa Rica and threaten and intimidate entire families and extended families using fear tactics and physical violence (see section 5.10.2.2) to bring resolution to their breathtakingly brutal policies.
It is this efficient means of terrorizing the family, bypassing intermediate persuasion and directly attacking – flensing the core of the family unit and its foundations, the heart, that brings successful conclusion to their policies of exclusion and prosecution of fear & terror against established structured mores.

The U.S. Embassy in Costa Rica- Ann Andrews and the US State Department are making every effort to deflect and block communications and information of these transgressions against the population of Costa Rica. They provide spy equipment and collude with the DIS covering up massive Constitutional and Human Rights violations.
The Presidential Police of Arias and Chinchilla “spy” out of control and have total immunity from the law through violations of Article #11 of the political Constitution of Costa Rica through ownership the Supreme court system.
For a short time on Sunday May 1, 2011 these constitutional violations reached a stunning climax when Oscar Arias and Laura Chinchilla preempted constitutional law and effected a “golpe de estado”- a “coup d’état of the constitutional Government of Costa Rica.
Shortly thereafter outraged citizens took to the streets to protest the illegal overthrow of the institutional government, due process and established law to bring an end to what has been termed ” the darkest day moment in the history of Costa Rica in the last 60 years.”
Please say NO! to the continuing and unchecked abuse of Presidential powers by Oscar Arias and Laura Chinchilla who with their secret Presidential Police have repeatedly harassed, blocked constitutional process, embezzled public funds, humiliated, assaulted, blackmailed and spied on thousands upon thousands of victims- families, students, judges, journalists, lawyers, congressmen and the vulnerable.
Other Rodrigo – Oscar Arias and Laura Chinchilla proclivities include their gigantic nationwide money laundering & extortion cartel operating inside the Presidential house and child pornography.
Recently our program uncovered a 300 agent spy and extortion ring of the Presidential Police-la DIS and OIJ (F.B.I.) whose principle function was and still is to intimidate and extort citizens.

The Arias-Chinchilla fear tactics and violence transcends all levels of society and does not discriminate. It metastases leaving scars that has seared the souls of thousands upon thousands of souls.
Your voice and heart can stop this. Please tell the United Nations, Human Rights organizations all who yearn for respect and dignity of human beings to say Yes to peace and NO! to Laura Chinchilla and the
